These Terms of Service ("Terms") govern your use of bookersystems.ai (the "Site"), operated by Booker Systems LLC ("Booker Systems," "we," "us" or "our"). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
1. About these Terms
These Terms cover the Site only. Any design, development, consulting or other services we provide to a client are governed by a separate written agreement, such as a statement of work or services agreement. If that agreement conflicts with these Terms, that agreement controls.
2. Using the Site
You may use the Site for lawful purposes and in line with these Terms. You agree not to:
- use the Site in any way that breaks applicable law or infringes anyone's rights;
- attempt to gain unauthorized access to the Site, its servers or any connected systems;
- interfere with or disrupt the Site, including by sending spam, malware or automated submissions;
- scrape, copy or harvest content or data from the Site at scale without our written permission; or
- submit information that is false, misleading or belongs to someone else without their permission.
3. Inquiries and submissions
Sending us a message through the Site does not create a client relationship, a contract or any obligation for either of us to work together. Please do not send confidential or proprietary information through the contact form; if we decide to work together, we can agree on how to handle confidential information in our written agreement.
If you send us ideas, suggestions or feedback about the Site or our services, you agree that we may use them without any obligation to you.
4. Intellectual property
The Site and its content, including text, graphics, logos, the Booker Systems name and marks, design and code, are owned by Booker Systems or its licensors and are protected by intellectual property laws. You may view and share links to the Site for personal or internal business purposes. You may not copy, modify, distribute or create derivative works from the Site without our written permission.
5. No professional advice
Content on the Site is for general information about Booker Systems and our services. It is not legal, financial, technical or other professional advice, and you should not rely on it as such. Descriptions of services, timelines and results are illustrative and not a promise of any particular outcome.
6. Third-party links
The Site may contain links to third-party websites or services. We provide them for convenience only, do not control them and are not responsible for their content, policies or practices.
7. Disclaimer of warranties
The Site is provided "as is" and "as available." To the fullest extent permitted by law, Booker Systems disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, secure or free of viruses or other harmful components.
8. Limitation of liability
To the fullest extent permitted by law, Booker Systems and its owners, employees and contractors will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising out of or related to your use of, or inability to use, the Site. Our total liability for any claim relating to the Site will not exceed one hundred U.S. dollars (US$100).
Some jurisdictions do not allow certain warranty exclusions or liability limits, so some of the above may not apply to you.
9. Indemnification
You agree to defend, indemnify and hold harmless Booker Systems and its owners, employees and contractors from any claims, damages, losses and expenses, including reasonable attorneys' fees, arising from your misuse of the Site or your violation of these Terms.
10. Governing law
These Terms are governed by the laws of the state in which Booker Systems LLC is organized, without regard to its conflict of law rules. Any dispute relating to these Terms or the Site will be brought in the state or federal courts located in that state, and you consent to their jurisdiction.
11. Changes and termination
We may update these Terms from time to time by posting a new version on this page and changing the "Last updated" date. Your continued use of the Site after a change means you accept the updated Terms. We may change, suspend or discontinue any part of the Site at any time, and may restrict access for anyone who violates these Terms.
12. General
If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any provision is not a waiver of it. These Terms, together with our Privacy Policy, are the entire agreement between you and Booker Systems about the Site.
